If it's dated before 1923, it's PD. Period. Since this print has no soundtrack, they haven't a leg to stand on. It's likely that they have their own version with a copyrighted sound track that they're trying to protect, and have a 'bot automatically shooting down true PD films. I've fought YouTube and won after a single round, so you shouldn't have too much trouble getting it back up.
